TCPA Website Compliance

To enable text messaging on your phone lines, your website must first pass a regulatory review by phone carriers. They require specific language and elements on your website and contact forms before approving SMS outreach.

This guide covers exactly what needs to be on your site to get approved.

Overview

Phone carriers audit three areas of your website before granting SMS approval:

Contact Form Requirements

Your contact form must include the elements shown below. The key requirements are annotated on the right.

Place your company logo directly above the contact form so the brand is clearly associated with the consent language.

Phone number field

The form must include a dedicated phone number input field since this is the number that will receive SMS messages.

Opt-in checkboxes

Add two separate checkboxes below the form fields. Neither checkbox should be pre-checked or required to submit the form.

Checkbox 1 - SMS consent:

By checking this box, I agree to receive informational/transactional text messages from [Your Company Name] regarding my inquiry. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help.

Checkbox 2 - Legal agreements:

By checking this box, I agree to the [Privacy Policy] and [Terms and Conditions].

"Privacy Policy" and "Terms and Conditions" must be hyperlinks pointing to the corresponding pages on your site.

The SMS consent checkbox must not be required to submit the form. Consent cannot be a condition of purchase or service.

Privacy Policy Requirements

Your privacy policy page must include a "No Sharing" clause. Carriers check for this exact language (or very close to it):

Mobile information will not be shared with, sold to, or disclosed to third parties, affiliates, or lead generators for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

If your privacy policy already has data-sharing language, keep it - but make sure the paragraph above appears verbatim as its own section. Carriers specifically search for this wording.

Terms and Conditions Requirements

Your website must have a publicly accessible Terms and Conditions page. This page should be linked from the second checkbox on your contact form.

  • Company logo is placed directly above the contact form
